Splikity is committed to maintaining your privacy. Please read through all the terms of this Privacy Policy so that you understand what type of personal information Splikity collects, how Splikity collects it, how Splikity uses it, and to whom Splikity discloses the information.

This Privacy Policy explains the privacy practices of the Splikity Applications, a product of Clarcore, LLC, an Arizona Limited Liability Company (hereinafter "Splikity", "we", "us" or "our"). This Privacy Policy applies to (1) the access and use of the www.splikity.com website, and any related sub-domains, which are operated by Splikity and/or a service provider that has contracted with Splikity for a white-labeled product (collectively the "Website"), (2) download and use of our proprietary applications and any extensions or other applications (the "Splikity Applications"), and (3) the provision by Splikity of services through the Website and the Splikity Applications (the "Services"). By accessing or using the Website or Splikity Applications, you agree to this Privacy Policy. 1. General Statement about the Splikity Applications

This Privacy Policy incorporates principles and standards that are designed to protect your passwords and other sensitive information you elect to provide to Splikity. Splikity Applications allow you to store your passwords for a variety of logins and websites and access them across multiple devices. The passwords you store in the Splikity Applications are encrypted on your device using a master password that only you know. Your passwords will be encrypted on your device and will be sent to Splikity in encrypted form through a secure connection for storage in order to enable synchronization with your other devices. Splikity never stores your master password on any server so your passwords can't be retrieved by anyone but you. When you need to access your passwords, the decryption of your passwords is done on your device with your master password. Your passwords can only be accessed by you with your master password. No Splikity employee can ever access your passwords.

We don't ask for your Personal Information unless we truly need it. We don't store your personal information on Splikity servers unless required for the on-going operation of one of our Services.

 

BECAUSE THE MASTER PASSWORD IS SPECIALLY CREATED BY YOU FOR YOUR ACCOUNT WHEN YOU SIGN UP FOR THE SERVICES AND IS NOT STORED BY SPLIKITY ON ANY SERVER, THERE IS NO WAY TO RECOVER YOUR ACCOUNT IF YOU FORGET YOUR MASTER PASSWORD.

2. A Note about Personal Information

For the purpose of this Privacy Policy, "Personal Information" means any information relating to a natural person (you) that is or can be identified, directly or indirectly, by reference to an identification number or one or several elements that characterize or allow someone to contact such person (e.g., your email address). Personal Information can be the personal information you provide upon registration with the site or information that you elect to store within the Splikity Applications. The Personal Information that Splikity collects is detailed in Section 4 of this Privacy Policy.

3. Consent to Policy

By accessing and using our Website or the Splikity Applications or by submitting Personal Information, you consent and agree to Splikity's collection, use, and disclosure of such Personal Information in accordance with this Privacy Policy (as amended from time to time) and as permitted or required by law. If you do not agree with the provisions of this Privacy Policy, do not provide us with any Personal Information or use any of the Services we offer on the Website or through the Splikity Applications. You can withdraw your consent at any time by following the instructions described below in the Section 8 of this Privacy Policy.

 

4. Personal Information We Collect

Splikity only collects Personal Information provided to us via the Website or Splikity Applications during the completion of the registration form, during the use of our Services, during sign-up for our Services, or while providing feedback or comments. Collection is limited to the following information: name and email address during initial registration and Personal Information you store within the Splikity Applications including usernames, and passwords (the usernames and password saved with Splikity are encrypted and not accessible by anyone, even Splikity employees, without your master password). Splikity cannot access any Personal Information that is encrypted because it is protected by a master password that only you know (this includes saved usernames and passwords). Splikity may also collect your Personal Information to contact you, from time to time, with information about software updates. To opt-out of these communications at any time, you can click the "unsubscribe" link at the bottom of the email communication.

Splikity may collect other information regarding your usage of the Services, whether accessed through the Website or the Splikity Applications as a registered or non-registered user, including your IP address, cookie or session information associated with Splikity, the date and time of your visit or use of the Splikity Applications, the type of internet browser or hardware device you are using, the URL of any other website that referred you to our Website or the Splikity Applications, URLs of the pages you visit, your browsing history and your bookmarks. This information is collected in order to improve your user experience. This information is not regarded as Personal Information unless you have registered for the Services. Upon registration, this information becomes Personal Information because it is linked with your account.

Splikity collects, stores, and organizes your Personal Information to allow you to synchronize this data across all your devices. Splikity is not able to access the encrypted passwords because the encryption and the decryption of these passwords occurs on your device with a master password that only you know and Splikity never stores your master password on any server.

5. How We Use Your Information

Splikity uses your Personal Information to manage your account, to optimize the Services we already provide to you, to provide updates for the Splikity Applications and to provide better customer service and experience.

To optimize and improve the Website or the Splikity Applications, or to generally improve our own operations, Splikity may use your Personal Information or usage information (as outlined in Section 4 of this Privacy Policy) for statistical purposes.

6. Splikity, Your Personal Information, and Sharing

Splikity will only share your Personal Information with select third party service providers for the purposes of facilitating the provision of the Services through the Website or Splikity Applications. Splikity will not share your Personal Information with any third party other than as described in this Privacy Policy. Splikity does not share your Personal Information, except to:

Allow service providers (e.g. a data hosting service provider) to process your Personal Information or otherwise facilitate or improve the Services. These service providers are used solely for the purposes of providing the Services to you through the Website or the Splikity Applications.;

Law Enforcement Officials and Government Agencies in response to an official request, when permitted or required by law, or in order to demonstrate that Splikity is compliant with applicable laws, rules, regulations, or guidelines.

To the extent that Splikity shares your Personal Information with third party service providers, those service providers are contractually bound to protect the confidentiality of your Personal Information and are only provided with Personal Information that is necessary to perform specific tasks for Splikity or you.

If another company acquires Splikity, its business, or its assets (including via bankruptcy) or if Splikity merges with another company, the acquiring or merging company will be given access to the Personal Information collected by Splikity. In such an event, it is possible that the Personal Information we possess could be sold, transferred, or otherwise shared as part of that transaction.

By using the Website or the Splikity Applications and providing Personal Information, you acknowledge that our service providers may be located in countries that have a different level of data protection than you have in your home country.

7. The Security of Your Information

Splikity is committed to the protection of your Personal Information. To serve this commitment, Splikity implements reasonable security measures that are designed to protect the security of your Personal Information both online and offline. Splikity uses strong encryption using the 256-bit AES cipher.

 

Offline, we restrict access to Personal Information to Splikity employees and agents who need to know that information in order to operate, develop, or improve the Services.

To protect the confidentiality of your Personal Information, we take appropriate security measures and we operate secure data networks protected by industry standard firewall and password protection systems. To protect your Personal Information during transmission and receipt, we follow generally accepted standards. The Splikity Applications is designed so that no one other than you – not even Splikity employees or service providers – can access encrypted Personal Information, because you are the only person with access to the master password that is necessary to decrypt that information.

Splikity has gone to great lengths to protect your Personal Information. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, Splikity cannot guarantee its absolute security. Additionally, the security of your Personal Information depends on how you use the Splikity Applications and Services and protect the master password that enables you to access your Splikity account and decrypt your Personal Information.

 

8. Accessing and Managing Your Information

You can access and rectify certain portions of your Personal Information directly on the Splikity Applications.

If at any time you wish to withdraw your consent to the use of your Personal Information, please notify us via email at [email protected]. Place "Delete My Account" in the subject line and include your first name, last name, e-mail address and user ID in the body of the e-mail. We will respond to your request within thirty (30) days. Please note that certain records, for example those pertaining to payments, customer service matters, or technical information associated with your usage of the Website or Splikity Applications, will be retained for legal, accounting, and technical purposes.

Please note that as a result you may not be able to use certain or all of our Services. Also, Splikity cannot edit the important encrypted passwords because the encryption and decryption of these passwords occurs on your device with a master password that only you know. Splikity never stores your master password on any server. If you lose your master password, Splikity will not be able to recover your account.

9. Splikity's Communications With You

Splikity may use the email addresses used when you register for the Services to communicate with you. When you register for a subscription to Splikity's Services, you automatically "opt-in" to receive email communication from us. These communications will comply with the CAN-SPAM Act of 2003.

Splikity may also contact you via email from time to time to notify you of changes to its Services, and maintenance notifications.

You will be permitted at any time to "opt-out" of the recipient of email communications related to marketing and promotional material. To "opt-out" simply click the "unsubscribe" link at the bottom of any email you receive. Even if you "opt-out" of receiving email communications, Splikity may, as necessary, email you in connection with a customer support matter or security issue related to your account.

10. Our Policies Concerning Children

The Services are not intended for children under the age of 13 and we do not knowingly collect any personal information from such children. Children under the age of 13 should not use the Website or Splikity Applications at any time. In the event that we learn that we have inadvertently gathered Personal Information from children under the age of 13, we will take reasonable measures to promptly erase such information from our records.

Splikity respects the U.S. Children's Online Privacy Protection (COPPA) Act of 1998 and upholds the guidelines of the Children's Advertising Unity (CARU) of the Council of Better Business Bureau, Inc. Please help Splikity by protecting your child's privacy by instructing them never to provide Personal Information on this website or any other without your permission.

If you are under the age of 18, please read this policy with your parents or legal guardians and ask questions about anything you do not understand.

11. Cookies and Sessions

Splikity's Website and the Splikity Applications may use cookies and sessions to track users. Cookies are encrypted and unidentifiable bits of information sent to your browser from a web server that is stored on your computer's hard drive. Cookies are set each time you register, or log in or log out of Splikity. Cookies may be used to store your username or email address so that you don't have to re-enter it each time you visit the Website.

We do not link the information we store in cookies to any personally identifiable information you submit while on the Website. Cookies may be set, accessed, or deleted on your computer by Splikity for the following reasons:

(1) to facilitate your "signing in" on the Website or Splikity Applications;

(2) to provide you with customized content;

(3) to keep track of preferences you specify while you are using our Services;

Splikity uses reputable tools to track non-personally identifiable information about visitors to our Website in the aggregate to capture usage and volume statistics. Some of our business partners do use cookies on our Website. We have no access to or control over these cookies. This Privacy Policy covers the use of cookies by Splikity only and does not cover the use of cookies by any third party.

13. California Privacy Rights

Splikity does not share personal information with third parties for their direct marketing purposes unless you affirmatively agree to such disclosure. If you do ask us to share your personal information with a third party for its marketing purposes, we will only share information in connection with that specific promotion, as we do not share information with any third party (other than our service providers) on a continual basis. To prevent disclosure of your personal information for use in direct marketing by a third party, do not opt in to such use when you provide personal information on one of our sites.

At this time, there is no consensus on how companies like Splikity should interpret "Do Not Track" signals. Splikity does not currently respond to "Do Not Track" signals, whether that signal is received on a computer or on a mobile device.

Splikity may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information and will always be at http://splikity.com/documents/privacy.htm. If we make a change to this policy that, in our sole discretion, is material, we will notify you via an email to the email address associated with your account or through the Services. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.

b. Limitation of Liability
